Supreme Judicial Court Finds Ranked-Choice Voting Unconstitutional

AUGUSTA – The Supreme Judicial Court today released a decision in response to the Maine Senate’s solemn occasion request finding ranked-choice voting, as passed on the ballot last November under Question 5, to be unconstitutional.

Page 45 of the ruling says,” The seven Justices of the Maine Supreme Judicial Court respond: Yes, the Ranked-Choice Voting Act conflicts with the Maine Constitution.”

“I am very pleased that the Supreme Judicial Court decided to weigh in on this important issue while the Legislature is still in a position to take action this session,” said Senate President Michael Thibodeau. “We will now work to review and fully understand the court’s ruling and look forward to working with our legislative colleagues to determine the next steps forward.”
